Dutch Public Prosecution Service (OM) summons foreign bank and employee on suspicion of dividend tax evasion
The Dutch Public Prosecution Service (OM) is going to summon a foreign bank and an employee on suspicion of dividend tax evasion.
Between 2009 and 2013, a subsidiary of a foreign bank located in Amsterdam filed five corporation tax returns. A total of 124 million euros in dividend tax was offset in those returns. The amount of dividend tax offset relates to a total of 825 million euros in dividends paid on Dutch listed shares.
Following an investigation by the Fiscal Intelligence and Investigation Service (FIOD), led by the Public Prosecution Service, the subsidiary is suspected of having offset the dividend tax in violation of the law and is therefore suspected of tax evasion. The Public Prosecution Service also holds the European parent company and an employee involved at the time responsible for this.
The court case is expected to start around the end of this year with a pre-trial hearing.
